A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his continued confinement lacks lawful basis.

"Since his return from wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her order.

The case stems from a mistaken deportation to El Salvador earlier this year, which the government later acknowledged was an mistake. After his return to the United States to face alien smuggling allegations, he was detained in immigration detention.

In her order, the judge pointed out that the government does not have a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."

The legal proceedings involve conflicting claims. While the Trump administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this claim.

He has also entered a not guilty plea to the conspiracy counts, which are part of a separate trial in the state of Tennessee.
